1. Booking and Payments
1.1. To secure a booking, clients must pay a non-refundable retainer of 50% of the total session fee. The remaining balance is due on the day of the scheduled session.
1.2. Payments are made by card on our booking platform managed by Setmore.com. The remaining balance can be paid by cash, card or bank transfer at the end of the session.
2. Punctuality and Late Arrival
2.1. Clients are expected to arrive on time for their sessions.
2.2. A £10 late fee will be requested for a delay exceeding 15 minutes and may result in a shorter session duration.
2.3. It is at DP Photography's discretion to extend the session duration based on the available time.
2.4. If the client is more than 30 minutes late, the session will be cancelled and is non-refundable and non-transferable.
2.5. If the Client wants to reschedule after the session start time, a £30 rescheduling fee will be requested.
3. Cancellations and Rescheduling
3.1. Clients may reschedule a session with at least 7 days notice (except in case of emergency/illness). Failure to provide sufficient notice will result in a rebooking fee of £20.
3.2. Only one reschedule will be allowed before incurring a further booking fee of £20.
3.3. In the event of a cancellation by the Client, the retainer is non-refundable.
3.4. DP Photography reserves the right to cancel or reschedule a session due to unforeseen circumstances, such as illness, weather or equipment failure. In such cases, a full refund or rescheduled session will be offered to the client.
3.5. DP Photography can not be held responsible for the weather. If the weather is not acceptable to the Client but is not a cause to reschedule, all standard rescheduling fees apply otherwise retainer is forfeited as a cancellation.
4. Copyright and Usage
4.1. DP Photography retains full copyright and ownership of all images created during the session.
4.2. DP Photography reserves the right for any photograph created during sessions to be displayed in the studio, portfolio, or in any other advertising directly associated with DP Photography unless the subject expresses a wish for their image to not be displayed. Confidentiality of the client is paramount.
4.3. Clients may use the images for personal use only, such as sharing on social media and printing for personal use. Commercial use of the images requires written consent and may incur additional fees.
5. Image Delivery
5.1. DP Photography will provide clients with edited, high-resolution images within 14 days via an online gallery. The number of images delivered will be as specified in the chosen package.
5.2. Clients are responsible for ensuring they download and save their images promptly. DP Photography is not responsible for the loss or damage of images after delivery.
5.3. All prints and products are to be collected by the client unless otherwise agreed and only in rare circumstances will it be agreed that items are sent via post or courier.
5.4. If it is agreed that the items are to be posted, DP Photography will make every effort to deliver photographs without risk of damage, however, we accept no responsibility for damage to any photographs whilst in transit if they are posted to you, and any loss or damages will be at the client's cost to replace.
6. Liability
6.1. DP Photography is not liable for any injuries, damages, or losses that occur during the session, either to the client or their property.
6.2. Clients are responsible for the conduct and safety of any individuals accompanying them to the session.
7. Child's Protection
7.1. A child is defined as a person under the age of 18 (The Children Act 1989).
7.2. DP Photography holds the right to use any of the photographic material of the children it photographs for advertising, use on websites, social media, leaflets, posters or by any other means. If the client specifically does not want to allow his child’s photo to be displayed by one of these means, written notice must be received by the parent or guardian of the child.
7.3. DP Photography will never reveal any personal details like the address of any child we photograph. However, some images may contain names / time and date of birth etc if that is the style of the photo. These may be displayed unless otherwise specified in writing by the parent or guardian of the child.
7.4. During the photo session, there may be times when the photographer may need to be assisted in manoeuvring the client's child into a position or pose. The client will always be asked if the child can be moved to a position. Exceptions to this would be a baby session where it would not be practical to ask permission for every moment and movement of a baby where the photographer has to manoeuvre them to gain the poses desired – during such sessions, the client will be made aware of the plans and will give consent when handing his baby, while still be in sight of the photographer.
8. Image Editing
8.1. Image editing includes basic retouching of skin (removal of small blemishes and flakes of skin), and creative input to enhance colours and backgrounds.
8.2. Editing does not involve drastically changing someone’s appearance.
8.3. DP Photography holds the right to charge additional fees for any additional editing or special requests by the client – any such requests will be accepted or declined at the discretion of DP Photography and whether they fit with DP Photography style or techniques.
8.4. Images are fully edited before being presented to the client and DP Photography holds the right to charge the client as per point 8.3 for anything additional.
9. Dispute Resolution
9.1. Any disputes arising from these terms and conditions will be resolved through negotiation and, if necessary, mediation or arbitration, in accordance with the laws of England.
10. Modification of Terms
10.1. DP Photography reserves the right to modify these terms and conditions at any time.
By booking a session with DP Photography, clients acknowledge that they have read, understood, and agreed to these terms and conditions.
